However, because Uber/Lyft set the prices, either their independent contractors are guilty of collusion or Uber/Lyft is guilty of price-fixing (independent contractors must be allowed to set their own pricing). Uber is going to have to either start paying their drivers more, paying for their driver's costs, or paying for their drivers' car insurance. I wonder if car insurance companies are going to start creating new plans for pseudo-commercial drivers. To ensure the safety of our community, Sidecar custom-created a commercial automobile liability insurance policy that covers up to $1 million of damage per occurrence. This policy is designed to cover driver liability for damage and/or bodily injury of passengers and third parties up to the $1,000,000 limit. This policy is liability only and does not provide coverage for collision, comprehensive, or wear and tear damage to a driver’s vehicle. Coverage under this policy begins when a Sidecar driver has accepted a ride through the passenger app and continues until the passenger exits the vehicle at the end of the ride." Lyft and Sidecar are precisely the kinds of businesses that should be prosecuted on sight.

If the SFMTA had either the wisdom or the capacity to enforce the law, it would discourage them, since it should not want to be perceived as granting passive acceptance of these "businesses."

As things stand all government agencies within shouting distance of these "businesses" are certainly morally, and probably legally, at risk for allowing them to go on.

The SFPD is probably laughing at the SFMTA for putting a stop to their pork-barrel enforcement practices, such as when five officers charged overtime for issuing the same ticket. All the cops have to do is let the MTA collapse under its own incompetence and impotence.
